Small business restructurings (Part 5.3B)
Since 2021, companies with liabilities under $1 million can appoint a small business restructuring practitioner. Unlike an administration, the directors stay in charge of day-to-day trading. The practitioner certifies the plan and helps put it to creditors within 20 business days.
Creditors do not meet; they vote on the plan in writing, and it passes if a majority by value of those who vote accept it. Employee entitlements and tax lodgements must be up to date before a plan can be offered. If the plan fails or is rejected, the company commonly moves into liquidation — which is why many companies on this list later reappear under a liquidation notice.
